Per C.R.S. § 16-3-102, a peace officer in Pueblo County may arrest an individual if a warrant has been issued or a crime has been committed in the officer's presence. Additionally, an arrest can be made when there is probable cause to believe that a crime has occurred and the individual in question is responsible.

After the arrest, the suspect is taken to the Pueblo County Sheriff's Office Jail Reception and Booking Center, where the officer completes the arrest report and the individual is booked into jail. Per Colo. Rev. Stat. §24-72-302, arrest records contain the following arrest and criminal records information:

Arrest records contain personal information about an apprehended person and details surrounding the arrest. In contrast, criminal records are documents containing information on a person's arrests, charges, pleas, or convictions for any misdemeanor or felony.

How Long Do Arrests Stay on Your Record?

Arrests remain permanently on a person's record in Pueblo County. However, Colorado law permits the expungement of certain arrests, which helps to restrict the record from the public. The Colorado State Archives provides arrest record retention schedules for counties in the state. Below is the Colorado Sheriff's Records Retention Schedule for arrest records:

Expunge Pueblo County Arrest Records

Arrested persons can petition the Pueblo Combined Courts or Municipal Courts to expunge their records by filing appropriate documents. They must review the statutes below to know if they are eligible for expungement:

  • C.R.S. 24-72-706 (Sealing of criminal conviction records): Applicants must get their criminal history record from the Colorado Bureau of Investigation (CBI). Within 20 days of getting the report, they must file a completed Motion to Seal Criminal Conviction Records (JDF 612) form and the report to the court. Upon review, the court will enter an Order Denying Request to Seal Conviction Records (JDF 613) if the defendant is not entitled to relief. A copy of the order will be mailed to the defendant. If the court approves the application, the judge will sign an Order to Seal Conviction Records (JDF 615). The processing fee for this service is $65.
  • C.R.S. 24-72-704 (Sealing of arrest records when no charges are filed): The petitioner must file a Petition to Seal Arrest & Criminal Records (JDF 417) with the appropriate court. However, the CBI will automatically seal the arrest record if the arrest was on or after January 1, 2022, and no criminal charges have been filed within one year of the date. The CBI will automatically seal arrest without a conviction that occurred after January 1, 2019, but before January 1, 2022, and no criminal charges have been filed:
  • Within three years of the arrest date for a felony offense where the statute of limitations is three years or
  • Within eighteen months of the arrest date for a petty offense, a misdemeanor offense, a civil infraction, a misdemeanor traffic offense, a municipal ordinance violation where the statute of limitations is 18 months or less, or if the arrest data does not specify the crime's classification.

Petitioners not qualified for automatic sealing must submit the appropriate form and pay a filing fee. Applicants who cannot afford the filing fee can submit a completed Motion to File Without Payment and Supporting Financial Affidavit (JDF 205) to the court. If the petition is approved, the judge will sign the Order to Seal Arrest and Criminal Records When No Charges Filed (JDF 418).

Pueblo County Arrest Warrants

An arrest warrant is an official document issued by a Pueblo County judge or magistrate that authorizes a peace officer to arrest a person accused of a crime. According to the Colorado Code of Criminal Procedure (CO Code §16-3-108), the court will only issue an arrest warrant when there is probable cause to believe that an offense has been committed and a person has committed it. An affidavit sworn to or affirmed before a notary public or a judge must be filed by the law enforcement officer. The accused must be brought before the judge immediately after the arrest.
