Arapahoe County Courts
The District and County Courts in Arapahoe County maintain records of criminal cases adjudicated within their jurisdictions. There are no legal provisions to expunge Arapahoe County arrest records for adults. However, eligible individuals may petition the court in the custody of their arrest records to seal them. Sealed arrest records are publicly unavailable but remain accessible to the court, law enforcement, and criminal justice agencies in the county/state.
Under Colo. Rev. Stat. Section 24-72-704, only individuals who meet any of the following requirements can petition to seal their arrest records:
- Individuals acquitted of the charges brought against them
- The criminal case was dismissed
- They completed a diversion agreement, and no criminal charges were filed as a result
- Individuals whose arrests did not result in court charges and the statute of limitations for the offenses they committed have expired
- Individuals who were arrested and not charged but are no longer being investigated for committing the offense despite the statute of limitations
To seal arrest records in Arapahoe County, complete the required forms, attach a copy of the arrest records, and then file the paperwork with the appropriate county court. Petitioners must file separate petitions to seal the records of different arrest incidents and pay a filing fee of $224 per petition.
The court may grant or deny petitions to seal arrest records with or without hearings. If a petition is granted, the court automatically seals the arrest records and sends an Order to Seal Arrest and Criminal Records to the agencies on the petition. Generally, such agencies will seal the arrest records in their custody within 30 days of receiving the notice.
However, the Colorado Bureau of Investigation (CBI) has the legal authority to seal Arapahoe County arrest records in its custody under the following circumstances:
- Records of arrests occurring on or after January 1, 2022, where no charges have been filed within a year of the arrest. The CBI seals such records within 60 days after the time elapses
- For arrests without a conviction after January 1, 2019, but before January 1, 2022, the CBI will seal the records if no criminal charges have been filed:
- Within three years of arrests for felonies with a three-year statute of limitations
- Within 18 months of arrests for misdemeanors, petty offenses, or municipal ordinance violations with a statute of limitations of 18 months or less

- By January 1, 2023, arrests from 2013 to 2018 that did not result in convictions will be sealed
- By January 1, 2024, arrest records from 2008 to 2012 with no convictions will be sealed
- By January 1, 2025, records of arrests from 2003 to 2007 that did not result in convictions will be sealed
- By January 1, 2026, arrest records from 1997 to 2002 with no convictions will be sealed
- By January 1, 2027, records of other arrests with no convictions will be sealed
